Note this is happenng for 20℅ of my converted files. And I have played 40gb .m2ts file with no issues.

have you updated the application (nero recode) in between the 40 working and the some not working?

I used Nero 12.5 Platinum for the initial conversions and then deleted the .m2ts so I cannot repeat.
I have since upgraded to Nero 14 which seems faster and more consistent - although still does not handle sub titles on bluray.
The offending MP4 titles play fine using WMP and Shark007 LAV codecs on W8.1
They also play fine using Mencoder and straight through processing (no encoder) although that is no longer a Transcode option.
They do not play using FFMpeg or tsMuxer.

I also found this FFMpeg 'issue' which was closed because they had trouble repeating the problem

Well it definitely looks like Nero does something weird with its files. Personally I use MeGUI which in my opinion is superior to everything else because it uses the raw tools and provides full transparency, instead of trying to automate things since in my experience with encoding, automation is what causes weird things.
But anyway I wonder if FFmpeg have inadvertently added support for those files now, can you please try replacing ffmpeg.exe with this one and see if that works? http://ffmpeg.zeranoe.com/builds/win32/ ... -static.7z

Also I'm gonna look into why the raw file option doesn't show up anymore.
